Company B is a well-known and established house building company. The company were unable to explain why a number of negotiations concerning confidential potential development opportunities had not been realised. In addition, a number of senior members of staff had recently left the company without clear explanation. Company B were concerned that the former employees had set up a rival company and had stolen confidential information to forward their business venture. This activity would be a contravention of their contractual obligations to the company.
Covert investigations and surveillance were conducted on a limited number of the ex-employees to ascertain their current working activities. It was established during this time that the former members of staff were meeting clients and suppliers of Company B and visiting potential sites for development that were currently being negotiated by Company B.
Over the course of the investigation and surveillance Esoteric Ltd staff established that six of the former employees had set up a rival company to Company B using information and Intellectual Property which they had stolen from their employers prior to leaving the organisation.
Based upon the amount of evidence gathered by the surveillance team a search and Seizure order was granted by the Court. An early morning search was conducted of the new office premises and homes of the former employees during which documents and electronic information was seized belonging to Company B.
It is clear from the activities, that company B incurred substantial loss of business by the former employees and civil action is now underway by Company B to recover their losses. |
